Wingert Grebing is pleased to announce that Andrew has been made a partner at the firm effective January 1st. He focuses his practice on legal malpractice defense and complex litigation, including class actions. Andrew has also argued before the First and Second Divisions of the Fourth District Court of Appeal.
Andrew joined Wingert Grebing in 2007, after working at another San Diego litigation firm. In 2005, he graduated, cum laude, from California Western School of Law. In addition to his practice, Andrew serves on the invitation-only Legal Ethics Committee of the San Diego County Bar Association, which works to enhance the legal profession.

Deborah will join the board in 2012. San Diego Defense Lawyers is an organization comprised of attorneys who represent defendants in civil litigation. Among the goals of the organization: to provide an educational forum for members, to promote an improved public perception of its members through service to the community and to maintain the standards of professional conduct.

A former employee of a local ammunition manufacturer contacted federal law enforcement officials regarding the company’s testing of certain ammunition. The company sued Jim and Andrew’s client, claiming the reports were false and that he gave misleading testimony in a civil matter related to the reports.
Jim and Andrew filed an Anti-SLAPP motion on the grounds their client’s statements to law enforcement officials and deposition testimony were protected and privileged as a matter of law. The company then agreed to dismiss the matter with no money being paid by the client.

The South Asian Bar Association of San Diego (“SABA-SD”) has introduced Srinivas as its secretary for 2011-2012. SABA-SD is a nonprofit organization open to all South Asian attorneys and law students, as well as others interested in South Asia and law. Its members include legal professionals of South Asian-American descent as well as those interested in the issues affecting the South Asian-American community.
Among the organization’s goals: to promote the professional and academic development of its members; increase the opportunities for South Asian-American legal professionals to participate in and lead civic and public affairs; and support efforts to increase diversity in the legal profession.

Following a jury verdict of more than one million dollars to their client in a Marvin v. Marvin contract dispute, the Fourth District Court of Appeal remanded the case to the trial court to determine the parties’ rights under a trust that controlled a multi-million dollar home. Jim and Andrew first defeated an Anti-SLAPP motion, then prevailed in a bench trial where, on behalf of their client, they recovered a one-half interest in real property worth more than one million dollars, more than $123,000 in attorney fees based upon the defendant’s breach of his duties as trustee, and more than $180,000 in damages for back rent for the property and breach of the Marvin agreement.

Chris will be among the featured speakers during a presentation at the San Diego County Bar Center from 5:30 to 7:00 p.m. on September 7, 2011. The program is entitled “Overview of the Children at Risk Programs.” He will present on the Mock Trial Video program. The Bar Center is located at 1333 Seventh Avenue, San Diego, CA 92101.

Charles Grebing and Andrew Servais prevailed on a motion for summary judgment while defending a local attorney sued by a former client. The trial court awarded the defendant more than $59,000 in unpaid attorney fees sought by a cross-complaint. The plaintiff appealed. After the Court of Appeal affirmed the judgment in its entirety, Wingert Grebing was able to collect more than $89,000 in unpaid legal fees, costs and interest for its client.

A client retained Wingert Grebing to oppose a motion for $170,000 in attorney fees and costs after losing a misappropriation of trade secrets claim on summary judgment. Eric successfully opposed the motion, then briefed and argued the matter on appeal. The Fourth District Court of Appeal affirmed the trial court’s decision and awarded costs on appeal.

From 5:30 to 8:00 p.m. on July 28, 2011, at the San Diego County Bar Center, Chris will lead an educational seminar entitled Proof Positive: Tests for Evaluating a Plaintiff’s Veracity. The program, sponsored by San Diego Defense Lawyers, will include panel presenters Sean Evans M.D. (Neurology), Dominick Addario, M.D. (Psychiatry) and Mark Remas, MA, CRC, ABVE (Vocational Rehabilitation). The panelists will discuss how they evaluate the legitimacy of an injury plaintiff’s claims, and will provide a foundational understanding for their methods of evaluation.

Wingert Grebing Brubaker & Juskie LLP and the Dyer Law Firm APC have joined forces. Mr. Dyer, a 30-year practioner and member of the American Board of Trial Advocates, is now of counsel with Wingert Grebing. His civil litigation practice involves representing a variety of commercial enterprises in the hospitality and health care industries. With the addition of Mr. Dyer, Wingert Grebing now has six ABOTA attorneys.
